Free Choice of Lawyer

In Belgium, the law of 4 April 2014 guarantees the insured's free choice of lawyer. The insurer cannot impose a specific lawyer, even if they may suggest partner lawyers.

Fee Caps

Insurers generally apply fee schedules for lawyer fees:

  • First instance: €1,500 - €5,000 depending on complexity
  • Appeal: €2,000 - €7,500
  • Supreme Court: €3,000 - €10,000
  • Mediation: €1,000 - €3,000

If fees exceed the schedule, the difference is your responsibility.

How to Choose?

Selection Criteria

1Covered areas: verify your main risks are included

Tax Advantages

  • The premium is 100% deductible as a business expense
  • 40% tax reduction on premiums paid for legal protection (law of 22 April 2019, capped at €310/year for individuals)
  • VAT deductible if you are VAT-registered

Claim Management

Step 1: Declaration

Report the dispute to your insurer as soon as possible (contractual deadline often 8 days after learning of the dispute).

Step 2: Analysis

The insurer analyzes admissibility and chances of success. A refusal must be justified in writing.

Step 3: Amicable Phase

The insurer first attempts an amicable resolution (letter, formal notice, mediation).

Step 4: Judicial Phase

If the amicable phase fails, the insurer covers the costs of judicial proceedings.

In Case of Disagreement

If you disagree with the insurer's decision (refusal or direction), you can resort to the objectification procedure: an independent lawyer examines your file and issues a binding opinion.
