Terms of Use
These terms govern access to and use of the LegalBelgique platform. Please read them carefully before any use.

1. Publisher and purpose
The LegalBelgique platform (the "Platform") is published and operated by Espero-Soft Informatiques SRL, with registered office at Rue de la Colonne 1A, 1080 Molenbeek-Saint-Jean (Belgium), registered with the Crossroads Bank for Enterprises under number BE 1033.022.383 (RPM Brussels, French-speaking division), VAT-registered under the same number ("LegalBelgique", "we").
These terms of use (the "Terms") set out how the Platform may be accessed and used. They supplement our General Terms of Sale, which specifically govern the ordering of services. In the event of conflict, the General Terms of Sale prevail with respect to orders.
Use of the Platform implies full acceptance of these Terms. If you do not accept them, please do not use the Platform.
2. Definitions
"Platform" means the website, the client area and all features accessible under the LegalBelgique brand.
"User" means any natural or legal person who accesses the Platform or creates an account. "Consumer" means any User who is a natural person acting for purposes outside their trade, business, craft or profession, within the meaning of Book I of the Code of Economic Law.
"Services" means all services offered by LegalBelgique, including assistance with company formation, amendment of articles of association, domiciliation, accounting, VAT activation and document preparation.
3. Nature of the services — important notice
LegalBelgique is an online administrative and legal services platform (legal-tech). It assists Users in completing their formalities, prepares standardised documents and coordinates procedures with the competent authorities.
LegalBelgique is neither a law firm, nor a notarial office, nor an accredited accounting firm. Services reserved by law to a regulated profession are, where required, carried out by the competent independent professional: the authentic deeds required to incorporate an SA, SRL or SC are executed by a notary; assignments reserved to chartered accountants or tax advisers are entrusted to a professional registered with the relevant Institute.
Information published on the Platform is of a general nature and does not constitute personalised legal, tax or accounting advice. It cannot replace the advice of a professional suited to your situation.
4. Access to the Platform and user account
The Platform is accessible 24/7, subject to maintenance operations and technical contingencies. LegalBelgique strives to ensure the availability of the Platform but assumes only an obligation of means in this respect.
Certain features require the creation of an account. The User undertakes to provide accurate information and keep it up to date. Login credentials are strictly personal and confidential; the User is responsible for safeguarding them and for any activity carried out from their account. Any suspicious use must be reported to us without delay.
5. User obligations and acceptable use
The User undertakes to use the Platform in good faith, in accordance with these Terms, the law and public order. They warrant the accuracy, sincerity and lawfulness of the information and documents they submit.
It is in particular prohibited to compromise the security or integrity of the Platform, to access data without authorisation, to impersonate a third party, to transmit unlawful content or to divert the Services for fraudulent purposes, in particular money laundering or terrorist financing.
LegalBelgique reserves the right to suspend or close, after notice, the access of any User who breaches these Terms, without prejudice to any remedy.
6. Orders, prices and payment
Orders for Services are governed by our General Terms of Sale. LegalBelgique's fees are stated exclusive of VAT (Belgian VAT of 21% applicable) and do not include legal fees and disbursements (notary fees, CBE registration duties, Belgian Official Gazette publication costs), which are listed separately.
Payment is made via the methods offered on the Platform (credit card, Bancontact, iDEAL, bank transfer) through our secure payment provider.
7. Right of withdrawal
In accordance with Articles VI.47 et seq. of the Code of Economic Law, the Consumer has a withdrawal period of 14 calendar days from the conclusion of the service contract, without having to give reasons or bear any cost other than those provided for by law.
By way of exception (Article VI.53, 1° of the Code of Economic Law), the right of withdrawal can no longer be exercised once performance of the service has begun, with the Consumer's prior express consent and their acknowledgement that they will lose the right of withdrawal once the contract is fully performed. In practice, starting a file (drafting articles, scheduling a notarial appointment, filing formalities) entails this waiver where the User has expressly consented to it.
To exercise this right, the User sends us an unambiguous statement, via the contact form or by email, stating their order number.
8. Liability
LegalBelgique is bound by an obligation of means. We make every effort to provide accurate, up-to-date information and quality Services, without however guaranteeing the complete absence of errors or omissions. The User remains responsible for the accuracy of the information they provide and for the decisions they make on that basis.
LegalBelgique cannot be held liable for indirect damage (loss of profit, revenue, clientele or data), nor for delays or refusals attributable to third parties (notary, CBE, FPS Finance, Belgian Official Gazette). Save for any mandatory legal provision to the contrary, our total liability is limited to the amount of fees actually received for the relevant service.
Nothing in these Terms limits LegalBelgique's liability in the event of fraud, gross negligence or harm to life or physical integrity, nor affects the Consumer's mandatory rights.
9. Intellectual property
All elements of the Platform (texts, images, logos, graphic identity, software, databases, document templates) are protected by intellectual property law and remain the exclusive property of Espero-Soft Informatiques SRL or its partners. Any reproduction, representation, adaptation or exploitation, in whole or in part, without prior written authorisation, is prohibited.
The User enjoys only a personal, non-exclusive and non-transferable right of use, limited to the needs of using the Platform.
10. Personal data protection
The processing of personal data is governed by our Privacy Policy, compliant with Regulation (EU) 2016/679 (GDPR) and the Belgian law of 30 July 2018, which forms an integral part of these Terms and is available on the Platform.
11. Amendment of the terms
LegalBelgique reserves the right to amend these Terms at any time, in particular to reflect legal, regulatory or technical developments. The applicable version is the one in force at the time of access to the Platform. Substantial changes affecting a User with an account are notified to them by appropriate means.
12. Partial invalidity and entire agreement
If any provision of these Terms is held to be void or unenforceable, the remaining provisions shall retain full effect and the provision concerned shall be replaced by a valid provision pursuing an equivalent objective. LegalBelgique's failure to enforce a right shall not constitute a waiver of that right.
13. Applicable law and jurisdiction
These Terms are governed by Belgian law. The parties shall endeavour to resolve any dispute amicably. Failing this, the courts of the judicial district of Brussels shall have jurisdiction, without prejudice to the mandatory rules protecting the Consumer, who retains the right to bring proceedings before the court of their domicile.
The Consumer may also use, free of charge, the Consumer Mediation Service (Boulevard du Roi Albert II 8, box 1, 1000 Brussels — mediationconsommateur.be) or the European online dispute resolution platform (ec.europa.eu/consumers/odr).
